Felony Theft Legal In Missouri.

In the continuation of reporting corruption this is an actual account of the events as they happened.

     On October 10, 2009 a contract was entered into by an elderly couple with an Oriental, calling himself Lee LY, address 1965 South Link, Springfield Missouri, 65804 and a Mexican calling herself Alma B. Casey, address, 22554 Lawrence  #1170, Verona Missouri, 65769.  The contract was for $1525.00 for delivery and installation of satellite equipment.  No merchandise was ever delivered or installed. This was felony theft as stated by Missouri statutes. Phone number of Lee Ly at time of incident, Cell 417-569-5651, Home # 417-942-0337.  Phone number of Alma Casey, 417-678-0722 Place of employment for Casey, Chase USA, Springfield MO.  417-225-4000.  #605-07-8196  This information provided by court records and the con artists themselves.   The elderly man of the before mentioned couple wrote to the Mexican, Alma B. Casey asking for the money to be returned or the merchandise to be delivered and installed as called for in the contract.  This is where the insanity began.

     Upon receiving the letter the Mexican Alma B. Casey responded by filing an ADULT ABUSE EX PARTE ORDER OF PROTECTION against the elderly man.  This resulted in a police action against the man who had never even had a traffic ticket before.  The Mexican Casey filed it to prevent a suit being brought against her, whereas if the EX PARTE had been enforced no contact would have been allowed for a year between the parties.  Pretty smart for a person who did not have legal status at the time.  The case was brought in Lawrence County Missouri, in the 39th Judicial Circuit.  Case #09LW-PN00240, sitting judge, Scott Shelby Sifferman.  This case should never have been brought foreward,  if the judge had actually read the petition before he signed off on it , there would have been no case. There was at the time a "person who guided the people filing EX PARTES"  in how to write the complaints up, her name Paulene Gage.  Ms. Gage fancied herself almost as an attorney, even though she was a lay person.  Casey committed perjury several times during her court testimony, perjury is not prosecuted in Missouri, here it is considered "normal."  The elderly man was represented by Attorney, Gregory Dorshorst of Springfield Missouri.  Mr. Dorshorst successfully  defended the man, and the EX PARTE was dismissed  "For Lack Of Credible Evidence."  This one time was the only time in this travesty of justice where the elderly man received any relief.

      Now before the EX PARTE was tried the man had filed complaints with the FTC and State Attorney General of Missouri.  For your information, any FTC complaints are filed and sent out to police departments and this is the end of it.  They take no action on these matters if you were thinking on filing on someone someday.  The State Attorney General of Missouri will write two letters to the offending party, this is the extent of their involvement. There is no Consumer Protection Department in Missouri.  An attempt was made to file a police report concerning this matter, since it was classified felony theft.  The Greene County Sheriff's Department had primary jurisdiction in the matter.  The department at first declined to take the report, stating this was a civil matter.  Upon advice from attorneys the elderly man once again approached the Sheriff's office and requested once again to file the complaint.  Upon hearing of an attorneys  involvement the department assigned an officer to take said complaint.  It was assigned to a Mark Smith (Lieutenant) with Greene County Sheriffs Department. The complaint was taken and the man was advised to call back in two weeks for action taken in said matter.  The complaint number 24110.  When the man called back he was informed this was a civil matter, the Greene County Prosecutor does not waste time on matters like this.  In fact felony theft of this nature is never prosecuted in this county, unless the theft was performed on a friend or relative of the Greene County Prosecutor.  This information was relayed to the man by Mark Smith (Lieutenant)  with Greene County.  This was the end of the matter , at least as far as law enforcement was concerned.  The man was actually laughed at and told to "Be more careful next time."

     A petition was filed against Defendant Alma B. Casey  on Dec. 27 2011 in the 31st Judicial Circuit in Springfield MO.  The case number assigned was 1131-CV18442  Jones V Casey.  Plaintiff's were represented by James R. Cox, local Springfield attorney, Defendant was represented by Harold F. Glass, also of Springfield.  Evidence was heard and a judgment was entered by Kevin Lee Walden, a visiting judge, if you want to actually call him a judge.  A reading of said judgment is available on line at case.net Missouri courts. 

     The following is a compiling of the facts which are mostly irrefutable.

Lee Ly is the son of Cong G. Ly (deceased)  He at the time resided at 1965 South Link Springfield Missouri.  He had allegedly married a Caucasian female and had a child with her.  This apparently caused the family great distress as in their customs this was a disgrace.  Apparently the marriage did not last.  He would seem to be completely without honor as he is also apparently a liar of some repute.  He alleges he works at federal courthouses as a computer technician.  One would wonder if this were true, should a thief have clearance to work on federal computers?  When the INS, Homeland Security, was questioned about his status there were three such entities with his name.  One was from Cambodia, one from Laos, and one Thailand.  He was allegedly Chinese, so maybe no one knows who he is.  The Mexican Casey was legal in US and no priors showing on her.  At the time she did have a traffic violation in Verona Missouri. 

     The two represented themselves as a team, Lee Ly was her tech/installer, she was the business end of said operation.  They had been referred by a mutual party known to all parties.  The first meeting Casey brought her teenage son and Lee Ly.  The son was introduced as being an apprentice, just learning the business, apparently the art of the con.  He wandered through the house and around the exterior, now there were guns all through the house as the couple collects military ordinance.  He had to be followed and this effectively divided the older couple and their attention.  If Casey and Ly had not been referred they would not have been allowed on the property.  They both alleged to be practicing Catholic, another or lie or maybe not.  The deal was made and checks were given to Casey which she subsequently cashed.  The court record verifies this.  The owners are avid believers of Missouri's so called Castle Law.  Casey is married to one Carl F. Casey of Verona Missouri.  Apparently she is from Texas and her maiden name is Gonzalez. 

     In the process of running the con they also presented a copy of hard drives they were selling.  These hard drives contained up to three thousand movies they had downloaded  from the net and were attempting to sell.  These movies were complete with the FBI warning attached at the end of each movie concerning duplicating said movies.  On the weekend that a movie entitled Zombieland was being released they had it on one of their hard drives.  Apparently they possessed some skills in this matter.  This was later reported to the FBI and to INS.  They absolutely had no interest in pursuing the matter.  The FBI was quoted as saying " Unless they are selling them by the tractor trailer load, we are not concerned."  If they had been selling in large quantities they said they would look at them as they could be supplying a terrorist group.  They said this was a matter for local police.  Police departments in Missouri do not investigate matters such as this. 

     After initial petition was filed against Casey she acquired an attorney, one Harold "Topper" Glass of the firm of Millington, Glass & Love of 1901 South Ventura, Suite A  Springfield Mo.  Harold can best be described as a want to be star from the sit com Happy Days.  He possesses a huge mane of hair, short fellow like the Fonz was, just lacking the leather jacket.  In his day he was described as a "Lion" in the courtroom, or at least this is his mantra.  The day of trial Harold appeared with absolutely no defense at all.  His presentation was as stated.  His client Casey was the mother of five, married and a hard worker at a call center, Chase USA ( Chase employees have access to millions of citizens names and all of their personal information, address, social security numbers etc.)  She was simply helping out a person she knew in his business, yes she instructed the plaintiffs in said matter to issue checks to her, yes she cashed  the checks but she gave the money away.  Therefore she was not unjustly enriched, see Mr. Judge I honest person, work hard. judge I never would steal from Mr. Jones, I have daughter in college, she honest person, husband honest person, I tell truth Mr. judge.  This was the complete defense of good old Harold "Topper" Glass.  In a real world this defense would have been laughable however this was in the domain of visiting judge KEVIN LEE WALDEN.  Kevin is a short, heavyset person who resides in Carroll County Missouri  He was recently reelected to another term, he ran unopposed, as this is an extremely small county, population wise.  Court is held in many of these small area only at certain times and days,  in the last few years the state has started requiring some of these country club judges to travel to larger counties and hear over flow cases.  These judges gripe at having to travel to hear these cases, never mind they only have to be in court a few days out of the month in their own counties.  As of this July all prosecutors and judges are getting a raise in salary.  They are going from $116,858.00 to $133,716.00  yearly pay.  This in a dying economy, strike that remark, a dead economy, there has not yet been the funeral for this country, it is just a long, long wake we are in.  In reading the "judges" Entry of Judgment" he actually contradicts himself in his own writing.  However it should be noted, many people believe " Judges are attorneys who are either to lazy or to ignorant to practice law in the day to day world, therefore they become judges"  You must admit working just a few days a month for their large salary is a good deal. 

     Upon leaving the courtroom the female counterpart of the husband and wife who were the plaintiffs in this proceeding was waiting outside the courthouse for the car to be brought around and Harold "Topper" Glass and his defendants walked by , not noticing the plaintiff and the Mexican Casey was pondering the results of said case, it was taken under advisement by Kevin Lee,  Harold was heard to say " Do not worry about the decision, it is going to go your way."  Perhaps "Topper" is a mind reader as well as a "Lion" in the courtroom.  This would lend a reasonable person to be concerned about something nefarious being in the works.  Well with Missouri being ranked 14th most corrupt in the U.S. anything is possible.  There was one moment in the trial that especially stands out, Harold "Topper" Glass asked the Mexican Casey if she was a legal resident.  Casey responded by saying she was a "Resident Citizen."  This produced a large smile from Casey and magnanimous smiles from "Topper" and Kevin Lee.  This writer has no idea what this title of "Resident Citizen" is.  Perhaps this was an inside joke.

     In summation if there is anything to be learned from this miscarriage of justice it can be stated:  If  you want to make money by way of the con, come to Missouri, you will not be prosecuted.  If you want to use the EX PARTE complaint as a means of helping your cause, come to Missouri, you will not be prosecuted for committing perjury.  If they actually took the perjury law seriously there would be no elected officials in Missouri.  They would all be in jail.  And last if you are a good looking Mexican female and desire to defeat the justice system in Missouri, look up good  old boy, Harold "Topper" Glass and hope you draw "Little" Kevin Lee Walden for the judge.
