Flawed People in a Completely Flawed State-More Missouri Actual Accounts of Utter Contempt For The Law

The following article will put forth the events as they happened.  This started as a simple lease of a property to two individuals.  This appeared to be another routine event which happens every day somewhere in the US.  The Lease was signed on June 7, 2014 and expired one year later.  Nothing uneventful happened for ten months except the usual being late on rent which is very typical for renters in Missouri.  Then the tenants one Heather Elizabeth Dang and her "girlfriend",  Brittany K. Dyer this is how they introduced themselves to the landlord decided to break lease two months earlier.  In typical renter fashion they simply decided to sneak out and not tell landlord and left no forwarding address.  As already stated this behavior is very normal in Missouri renters, they change landlord's and properties just like they change jobs, without notice.  Now this is where the problem began.  When the landlord discovered their leaving it was also discovered they had left two cats in the property.  They left the animals for one week and  then sneaked back, or at least someone did and removed them.  The landlord had kept them in food and water and was getting ready to remove them but was saved the trouble.  The real problem was in the abandoned car they left in the driveway.  The car was unable to be driven as they had removed the ignition from the steering column.  It was left with all four doors unlocked and the trunk also unlocked.  There was gas in the tank.  This was in an area of younger children, many not very well supervised or looked after and there were sometimes squatters in the area.  This was an extreme liability for the neighborhood and for the owner of the rental property. 

At this time a decision was made to contact the local police department to have the car checked to se if it in fact was a stolen vehicle.  The city police of Springfield Missouri proceeded to check the car for possible being a stolen vehicle, it was not reported stolen and as such was tagged with an orange sticker notifying the person in control of the vehicle they had ninety six hours to remove the car.  This is the normal procedure in these matters and owner of property was instructed it was his responsibility to have the car towed by a towing company.  The owner at this juncture was required morally and for insurance purposes to have the vehicle removed.  The owner of the property had been instructed by his insurance company State Farm Insurance he could be held responsible if any damages were sustained by leaving the vehicle there, since he was on file as calling in the vehicle and had done nothing to remedy the situation.  The property owner waited an extra forty eight hours and called a towing service to remove the car.  This had all been normal procedure until this time and the car was subsequently removed to a secure place.

The car was towed at approximately 3:00 p.m. on 04/23/2015, by a company called Affordable Towing.  At  approximately 7:26 p.m. the owner of the abandoned car Heather Dang and her "girlfriend" filed a sworn police report of a stolen car.  They named the owner of the property, their landlord as the thief, and demanded he be arrested and prosecuted to the full extent of the law.  This was police report SPD150423014930, there was another follow up report filed by Greene County Sheriff  GSC150423002385.  There was no attempt made by either law enforcement division to arrest the "car thief" the terrible old landlord.  This was just an attempt by two tenants to attempt to scare off the landlord from filing suit against them.  However  in the corrupt state of Missouri there is protocol for removing such an abandoned vehicle.  It would appear the landlord should have left the car sitting there for thirty (30) days prior to removing.  This would have left a potentially dangerous car unattended for anyone to tamper with.  This is your usual "catch 22" another common flaw in an already deeply flawed state.  The landlord did the responsible thing and had the car secured behind a locked compound.  The city should have intervened, and removed the vehicle but will not come onto private property to remove.  This is your typical insanity of American laws.

The landlord then proceeded on with a damages suit and recovery of the rental unit.  The original petition was filed on July 02, 2015 at 01:53 p.m., this was filed by attorney Douglas A. Carter of Springfield Missouri.  The attorney's place of business is listed as 2847 S. Ingram Mill Road, Suite A-100 Springfield Missouri 65804.  This was case number 1531-AC03857, this petition was filed under the wrong name for the plaintiff and as such would have rendered any judgment null and void.  The plaintiff notified the attorney of the mistake and the attorney was quoted as saying "I have not seen the petition, but if this is true it is no big deal". The attorney had in fact signed his name to the original petition.  As to whether he in fact had actually reviewed the document before filing with the court is debatable.  In Missouri they can file on line so anyone could in fact file a petition if you could  access the attorneys account with the court.  The first appearance the plaintiff's attorney Carter was in the court room, the attorney for the defendants was not present.  She asked the plaintiff's attorney to stand in for her as she was just to busy running around town to show up.  This seemed odd but the attorney Carter did just that and asked for a continuance, which is very common on the first appearance.  In addition to filing under the wrong name for the plaintiff he failed to ask for possession of the property to be returned to the plaintiff. 

The attorney for the defendants was one Nancy J. Fisher, business address of 943 North Boonville Avenue, Springfield Missouri  65802.  Phone number (417) 612-0521.  After doing a small amount of checking on this attorney it was observed she did not actually like or practice actually taking a case to trial.  Her technique was to continue and continue hoping the other party would get tired of the attorney games and drop the case.  This is another common tactic employed by many attorneys, indeed even the prosecutors who also never go to trial, everything is settled out of court by using scare tactics.  The defendants attorney, Fisher also used the old  " my clients are going to offer an out of court settlement" this was also just a common falsehood many attorneys utilize.  On the next court date the plaintiff was there again, the plaintiff's attorney Carter and defendant's attorney Fisher were all in attendance.  Once again Fisher asked for a continuance, the plaintiff pinned down his attorney Carter and asked why the name had not been corrected on the petition and expressed dismay at another continuance.  Carter realizing he could not milk the case any longer said he was going to vacate the case right then.  He expressed this to the judge and was allowed to leave. The plaintiff did not object as he was not getting adequate representation.  This was on 9-23-2015.  The case was once again given a new date.  The attorney Douglas A. Carter was so forward he actually sent a bill for his totally inadequate service.  This continued on, no possession of the property back to the owner and no court date.  This is how the court games are played in the corrupt state of Missouri.

The credibility and integrity of the defendants attorney Ms. Nancy Jeanette Fisher seems to be debatable at this time.  It seems she had two default judgments placed against her in the year 2015.  Both default judgments appear to be bank type loans of which she appears to have stopped making payments on.  The first one is case #1531-AC00577, this one is for a total of $13,116.43 plus costs and the second one is for case #1531-AC04626 in the amount of $1,605.35 plus costs.  These are both in the 31st Judicial in Greene County Missouri.  These are documented by casenet.com Missouri  The attorneys home address is listed as 2144 N. Howard Springfield Missouri 65803.  It would appear by the court postings she was difficult to be served the court papers.  Now this attorney was at the time of judgments representing clients as the case involving the two female tenants was ongoing.  Apparently she was not getting paid or she just decided to not pay back the money she owed to the banking establishments.  Whatever this says about her character is in the minds of the readers who are able to read between the lines.

After the withdrawal by attorney Carter the plaintiffs were able to acquire competent representation by a large established law firm and proceed onward.  The case was finally settled on 1-7-2016 after being filed on 7-2-2015, cases like these are normally finished in the first court date if not the second.  It took all this time to acquire legal possession of the property.  There was a money judgment of $1600.00 agreed to by the defendants and promise to pay was set for every thirty days .  Most people who deal in these issues realize promises made by people who have done everything possible to avoid a trial will not pay what they owe without being forced to by more involvement with the courts.  This case is no different, to date the defendants have made no effort to pay their debt.  They would appear to be just more of the types of people who live in the US and try to get over on anyone they can.  As the fight promoter Don King used to say "Only In America."

Follow up information on these two individuals:  This information gleaned from police, court and personnel records.  There is not much showing on the Brittany K. Dyer, DOB 8/08-90, #4976,  DL #R205229011.  The partner in this tryst one Heather Elizabeth Dang  aka Heather Elizabeth Debert.  DOB 12/20/88  #7749  DL T056222014.  It would appear she is continuing her ways of attempting to circumvent the law, on 1/24/2016 Debert received a ticket for Failure to Register Motor Vehicle which she pled guilty to.  This being case #701885870.  In her past she must have been having an identity crisis, at some point she married one Huy Quoc Dang, this must have been her attempt to be a straight female.  Apparently she could not figure out at her adult age which sex she preferred.  There is also the possibility she simply  married this person to enable him to secure citizenship, for a reasonable fee I would assume.  This is also very common in the corrupt country of the US.  At any rate she filed for divorce on 11/03/2014 and was officially divorced on 12/05/2014 according to court records and her name was changed back to Debert.  This according to casenet in Missouri #1431-DR01860.  Debert claims to possess a Bachelors of Arts, in Psychology in 2015 and an Associates of Science, in Criminal Justice from the University of Missouri- St Louis Missouri in 2011.  This would be odd having these degrees and the only job she could acquire was a babysitting job for the City of Springfield MO. and another job working at a day care center, Where Families Grow, LLC   2872 South Meadowbrook Avenue Springfield Missouri  65807.  It would appear these organizations do not do a very in depth background check of their people.  I would venture a guess this is because they pay so very little salary to their employees. 

It would seem the attorney who represented these females has yet another suit filed against her for apparent failure to pay her bills.  This being Ms. Nancy Fisher, this case on casenet. is #1631-AC01589, I would imagine when the judgments get large enough she will claim bankruptcy and walk away clean.  This would be the third one thus far.  Anyone can be an attorney in the corrupt state of Missouri.  On the follow up on May the fifth 2016 this attorney received a default judgment on this case in the amount of $1651.21  plus costs.  Her escapades will continue to be followed and reported.
